Greg Vanden-Eykel featured in Rhode Island Lawyers Weekly article on slip-and-fall case

Greg Vanden-Eykel was featured in the Rhode Island Lawyers Weekly article, “Indemnity allowed in slip-and-fall suit,” related to the indemnification clause in a winter services contract between an assisted living facility and landscaping contractor.

The contract required the landscaping contractor to provide ice management services at its own discretion and without limitations, and included a clause indemnifying the healthcare facility from any negligence as a result of these actions (including lawsuits, losses and costs, etc.). A Superior Court judge granted the plaintiff assisted living facility partial summary judgement in the case. “The fact that [the contract] was crafted so narrowly allowed the court to find the indemnification provision enforceable,” Greg notes. He also commented that the judge’s ruling in this case would be of particular interest given an increase in premises liability litigation involving healthcare facilities and their service providers.
